Kaushal’s Media Private Limited, a company incorporated under the Companies Act, 1956 with its registered office at 901-902,  Hiramanek CHS Ltd., 178/180 Dadi Seth Agiary Lane, Chira Bazar, Mumbai 400002 (“Company”, “We”, “Us” or “Our”) is managing and operating this website www.imeandesign.com (“Website”), which inter alia facilitates the sale and purchase of products and services listed and sold (“Products”) on Our Website. The term “User”, “You” or “Your” means any individual which uses, accesses or browses the Website and/or purchases the Products on Our Website.

The Terms of Use published on the Website shall be deemed to be incorporated herein by reference. This Policy, read together with the Terms of Use, sets out the Company’s procedures and policies governing cancellations, returns, and refunds. Any cancellation, return, or refund of products by You shall be subject to the terms and conditions specified under this Policy.

1.    CANCELLATION

Once an order has been placed by You, it cannot be cancelled unless the Company cancels it for any reason.

2.    RETURNS AND REFUND

We take great care to ensure that our products reach you in perfect condition. However, if you receive a product that is defective or damaged, you may request a return or replacement in accordance with the terms below.

2.1.    General Guidelines

You are requested to open the package carefully upon delivery and video record the unboxing process to serve as proof in the event of any return or damage claim. Please note that without an unboxing video, no request for return, replacement or refund will be processed.

Customized, made-to-order or commissioned products cannot be returned, exchanged or refunded under any circumstances.

If, at the time of delivery, the product is opened and found to be damaged, defective, or incorrect, you must inform us within 48 (forty eight) hours of delivery by writing to info@imeandesign.com with supporting photos and the unboxing video.

Upon receiving your claim, we will review the issue and, if approved, arrange for either replacement of the defective product, refund of the purchase price or issuance of credit note for the value of the product, at Our sole discretion.

If the same product (or part) is not available, a credit note for the value of the product will be issued.

Replacement shall be for the entire product and not for specific part(s) and is subject to availability.

2.2.    Conditions for Returning a Product

When returning a product, please ensure that it meets the following conditions:

(a)    The product must be in its original condition and original packaging.
(b)    The product must be securely packed to prevent damage during return transit.
(c)    The package must include the original delivery slip/invoice.
(d)    Returns must be sent through a reliable courier or delivery partner.

Once we receive the returned goods and verify their condition, a credit note equivalent to the full purchase price (excluding taxes and shipping charges) will be issued to Your account or refund of the purchase price will processed within 7 (seven) working days from the date of receipt of your return.

Please note that taxes and duties are non-refundable.

2.3.    Products Not Eligible for Return or Replacement

The following products shall not be eligible for return, replacement, or refund:

(a)    Products specifically mentioned on Our Website as non-returnable.
(b)    Products with minor variations in colour, texture, or finish from the images displayed on the Website, or those made to order.
(c)    Products damaged due to misuse, mishandling, or improper maintenance.
(d)    Incidental damage caused by malfunctioning of the product.
(e)    Products with tampered or missing serial numbers, labels, or SKU tags.
(f)    Digital products or services.
(g)    Damage or defects not covered under the manufacturer’s warranty, if applicable.
(h)    Any product returned without all original packaging, accessories, manuals, and items originally included with the delivery.

2.4.    Handling Fees and Other Charges

Certain returns may attract a handling fee of up to 10% (ten percent) of the purchase value, depending on the nature of the product and seller policy.

Shipping and handling charges incurred for return or replacement are non-refundable, unless the return is due to an error by the Company.

2.5.    Lost Shipments

If you choose to self-ship the product(s) for return and the package is lost in transit, We shall not be responsible for any refund or replacement.
 
2.6.    If Company has suspicion or knowledge, that any of its Users are involved in any activity that is intended to provide claims or information that is false, misleading or not genuine, then Company may while reserving its rights to initiate civil and/or criminal proceedings against such User may also at its sole discretion suspend, block, restrict, cancel the display name of such User and /or disqualify that User and any related users from availing protection under this Policy.
 
2.7.    Company reserves its right to initiate civil and/or criminal proceedings against an User who, files an invalid and/or false claim(s) or provides false, incomplete, or misleading information. In addition to the legal proceedings as aforesaid, Company may at its sole discretion suspend, block, restrict, cancel the account of such User and/or disqualify that user and any related users from availing protection under this Policy. Any person who, knowingly and with intent to injure, defraud or deceive, files a fraudulent complaint containing false, incomplete or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law.
